Please read these Terms and Conditions carefully before using the MOMUTO website (the "Service") operated by MOMUTO Group Limited, a limited company registered in Hong Kong (registration number 80176079), with registered address at Room D07, Phase 8/F, Kai Tak Factory Building, 99 King Fuk Street, San Po Kong, Kowloon City District, Hong Kong ("us", "we", or "our").

1. Agreement to Terms

By accessing and using our Service, you agree to be bound by these Terms and Conditions. If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, and customers worldwide, including those in the European Union.

2. User Accounts

To use certain features of our Service — such as designing and ordering football kits — you may be required to register for an account. When you do so, you must provide accurate information including your name, email address, telephone number, and delivery address. This information is handled in accordance with our Privacy Policy.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. User Content and Designs

You may upload logos, artwork, or other materials ("User Content") when designing your kit. You retain ownership of any intellectual property rights in your User Content. By uploading User Content, you grant MOMUTO Group Limited a non-exclusive, royalty-free licence to use, reproduce, and display it solely for the purpose of fulfilling your order and, where you have given separate consent, for marketing purposes.

You are solely responsible for ensuring that your User Content does not infringe any third party's intellectual property or other rights. We reserve the right to reject designs that incorporate trademarks or logos of third-party brands without verifiable authorisation.

Original design templates created by MOMUTO Group Limited remain our intellectual property.

4. Orders and Payments

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion. Prices are displayed in EUR and USD. We accept payment via secured credit card gateway and PayPal. We do not store your payment card data.

For customers in the European Union: you have the right to cancel a standard order within 14 days of receipt under the EU Consumer Rights Directive, except where the goods have been customised or personalised to your specifications. Custom kits are exempt from this right of withdrawal as they are made to your individual specifications.

5. Returns and Refunds

We will accept returns and provide a full refund or replacement where a delivered product is materially different from your approved design, or has a manufacturing defect. Claims must be submitted within 14 days of delivery with photographic evidence to info@momuto.com. We do not accept returns for personalised items that match the approved design.

6. Shipping and Delivery

We ship worldwide. Estimated production and delivery time is approximately 20–25 days from order confirmation. Delivery timelines are estimates and may vary due to customs clearance or other factors outside our control.

For international shipments, the customer is responsible for any applicable import duties, taxes, or customs fees imposed by the destination country. MOMUTO Group Limited is not liable for delays caused by customs authorities.

7. Privacy

Our Privacy Policy describes how MOMUTO Group Limited collects, uses, and protects your personal data. By using our Service, you acknowledge the data practices described in the Privacy Policy. Where required by applicable law — including the EU General Data Protection Regulation — we will obtain your consent before processing your personal data for purposes other than fulfilling your order.

8. Intellectual Property

The Service and all original content, features, and functionality (excluding User Content) are owned by MOMUTO Group Limited and are protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our express written permission.

9. Limitation of Liability

To the maximum extent permitted by applicable law, MOMUTO Group Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service or any products purchased through it. Our total liability for any claim shall not exceed the amount you paid for the relevant order.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.

10. Dispute Resolution and Governing Law

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.

We will attempt to resolve any dispute informally in the first instance. If we are unable to resolve a dispute within 30 days, either party may refer the matter to the courts of Hong Kong, which shall have exclusive jurisdiction — subject to any mandatory consumer protection rights you may have under the laws of your country of residence.

EU customers: nothing in this clause affects your rights to bring claims before the courts of your country of residence or to use applicable EU alternative dispute resolution mechanisms.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
